    Mass. Delays Antismoking Campaign Pending Outcome of NYC Case

    The Massachusetts Department of Public Health won’t proceed with requiring retailers to post graphic warning signs about smoking until an industry lawsuit against a similar campaign in New York City is resolved, USA Today reported July 14.

    “We are not going to take any action until after the initial hearing in New York City,” slated for Oct. 14, said Massachusetts health department spokesperson Jennifer Manley.

    In December, New York City began requiring tobacco retailers to post 4×4-foot signs showing photos of lungs, teeth, and brains diseased by smoking. Stores that fail to comply would face fines of up to $2,000.

    Tobacco retailers and companies have sued the city, saying the municipality doesn’t have the authority to require the signs — only the federal government.
